i know the 07s were but theres nothing on the KTM site that says the 09s are.

if not is there a kit or something i can get to make it street legal?

Street legal

'09 are street legal, same as the '08. Except the '09s should start better as KTM fixed the cam/ decompression that some '08 had.

I was at the dealer yesterday and all the EXC bikes are street legal. I like the '09 graphics.
